You may be aware through media reports that NUMSA is preparing for a possible national mass action (stay-away) on 26 February 2014.

Attached is an article on the proposed action that appeared in Business Day on 28 November 2013 and a NUMSA memorandum addressed to all NUMSA organised companies.

It would appear that NUMSA has, so far, complied with the provisions of Section 77 of the Labour Relations Act (LRA) regarding socio-economic protest strike action in that an application has been lodged with NEDLAC.

Importantly and before any action can take place, the matter must first be dealt with by NEDLAC in line with the provisions of Section 77 of the LRA and if the matter remains unresolved, economic protest strike action (i.e. a stay-away i.e. no-work-no pay, no disciplinary action) may proceed.

Please note that to date no official confirmation by NEDLAC and/or BUSA has been received by SEIFSA but a BUSA meeting has been scheduled on 12 February 2014.

Once confirmation has been received, either before the 12 February or sooner, SEIFSA will circulate and post an official SEIFSA Management Brief on the website on the legality of the proposed action and recommended management action therein.
